In a judgement delivered on 19th November 2010 by the Honourable Lady Justice Rawal, the judge noted that the scurrilous allegations that have been published by the said Mr. Tilleman had no foundation in law or in fact. In the learned judge’s words, “it is sufficiently proved that that the defamatory words were grave, widely circulated in electronic media and it is continous even till the date of hearing of this case. The Defendant has not been deterred and has contemptuously ignored to either appear before the court or to offer an apology.”
The court ordered Mr. Tilleman to pay the Firm Kshs. 2,500,00/= in general damages and Kshs. 1,500,000/= in punitive damages for his unlawful and illegal actions.
Mr. Tilleman has fled the country and has declined all invitations to return to Kenya and take responsibility for his actions. He continues to send bulk emails to various members of the legal fraternity and to clients.
We are happy that the High Court of Kenya has vindicated the position the Firm has taken that the allegations that Mr. Tilleman are unjustified and are purely calculated to damage the Frim’s reputation.
We would urge all our clients and all members of the public to ignore and treat Mr. Tilleman’s allegations with the contempt they deserve.
